General conditions - Private, semi-private and group lessons
By registering with Studio Swiss Pilates & Yoga and paying for the services required, you (the "Client") enter into a contract with Studio Swiss Pilates & Yoga, for the services of Yoga and Pilates classes, which are given for the most part . This contract is subject to a number of terms and conditions which are detailed below.
We therefore ask you to carefully read the following and accept the contents of our terms and conditions before registering with MindBody Online or directly at Studio Swiss Pilates & Yoga.
The use of the masculine form in these terms and conditions is generic and refers to both women and men.
Objective
Studio Swiss Pilates & Yoga provides the Customer with Yoga and Pilates class services which the Customer agrees to pay at the rate in effect at the time of payment.
Pricing
The price of each lesson is deducted from the amount paid in advance by the Customer in accordance with point 3 below, until the credit is exhausted. The prices are given as an indication. Studio Swiss Pilates & Yoga reserves the right to modify them without notice. In the event of a price increase, the Customer will continue to benefit from the price in force at the time of payment, until the corresponding credit is exhausted.
Payments
Classes can be paid for in advance via the Mindbody Online platform or on-site, before the start of the class.
Classes are sold individually, in packages, or as subscriptions. Purchased classes are non-refundable, and the corresponding credit must be used by the client within a period of: a
maximum of 3 months from the date of the first visit for individual classes (private, semi-private, and group) and the 12-class package; a maximum of 12 months from the date of the first visit for one-year subscriptions; 10 weeks for the 5-class semi-private or private package; and 15 weeks for the 10-class semi-private or private package. The subscription is effective from the date of the first visit. If the credit is not used within the allotted time after purchase, the amount paid is forfeited to Studio Swiss Pilates & Yoga at the end of this period, without Studio Swiss Pilates & Yoga being obligated to provide the agreed-upon services to the client.
Suspension of subscriptions / packages
All subscriptions and packages can be suspended for reasons of illness/accident upon presentation of a medical certificate. Any suspension must be made by email with a supporting document before the start date of the suspension. During a suspension, the subscription or plan is completely suspended and extended if necessary for the period of suspension.
Booking and course schedule
All class bookings can be made in advance or directly on-site, subject to availability. Bookings can be made online through the MindBody Online system, accessible via the website www.swisspilatesandyoga.com, or directly with the studio.
No guarantee is given regarding class availability, as bookings are honored according to their priority, nor regarding the identity of the yoga or Pilates instructor for a given class. The class schedule is subject to change at any time. The schedule updated on the MindBody Online booking system is definitive.
If the minimum number of participants is not reached, a class may be canceled.
Studio Swiss Pilates & Yoga also reserves the right to refuse entry to the studio to any client who does not respect the studio environment or to ask a client to leave the studio during a yoga or Pilates class if the client interferes with the practice of other participants.
Course cancellations and delays
A reservation can be canceled with a minimum notice of 24 hours. In case of cancellation without respecting this deadline, the course will be credited. The client should ideally arrive 10-15 minutes, at the latest two minutes before the start of a class. If this is not respected, Studio Swiss Pilates & Yoga reserves the right to assign a place reserved by the customer to another waiting customer. The studio will be locked once class starts on time. Any delay will also result in a late cancellation.
Customer health information
The classes offered by Studio Swiss Pilates & Yoga are not medical training. As with any physical exercise, there are a number of health risks, which the client acknowledges and accepts.
These risks may be increased by the client's existing health conditions. For this reason, Studio Swiss Pilates & Yoga can only provide services to the client on the express condition that the client...
- informs Studio Swiss Pilates & Yoga, at the latest during the first class, if he suffers from a heart, respiratory or joint disease;
spontaneously informs Studio Swiss Pilates & Yoga of any other circumstance relating to the Client's health or medical history (including cosmetic surgery) which could affect or be affected by the classes offered by Studio Swiss Pilates & Yoga; - immediately inform Studio Swiss Pilates & Yoga of any change in circumstances resulting from the information initially provided in accordance with the above.
In case of doubt, it is the client's responsibility to consult a doctor of their choice at their own expense before making the first payment, in order to determine their fitness to participate in the physical training offered by Studio Swiss Pilates & Yoga and to inquire about any relevant circumstances they may not be aware of.
It is the sole responsibility of pregnant women to determine with their doctor whether a yoga or Pilates class is suitable during pregnancy.
The client must carefully follow the instructions given by the yoga/Pilates instructor during each class. In the event of discomfort, shortness of breath, dizziness, heart rate fluctuations, muscle pain, or any other physical symptom during a class, the client agrees to stop the exercise immediately and inform the yoga/Pilates instructor.
Studio Swiss Pilates & Yoga cannot be held liable for any harm to the client's health resulting from the client's failure to comply with the aforementioned obligations.
Public liability
In its relationship with the client, Studio Swiss Pilates & Yoga generally disclaims all liability, except for damages caused intentionally or through gross negligence.
The client confirms that they are fully responsible for any injury that may occur during the class. The client agrees to follow the instructions given during the class and to practice at an intensity level appropriate for them.
Classes are not a substitute for medical treatment, diagnosis, or examination and are not recommended under certain conditions. The client decides at their own discretion whether they are fit to participate in the classes. The client waives any claim against Studio Swiss Pilates & Yoga for Yoga and Pilates classes.
The client is also solely responsible for the safety and integrity of all personal belongings they bring to class and/or leave in the changing room.
Electronic Communications
The registration process, related payments, and class bookings can be completed online through the MindBody Online system, accessible via the website www.swisspilatesandyoga.com. Electronic communications exchanged between the Client and Studio Swiss Pilates & Yoga in this regard are secure. The Client is advised that registration, payment, and class bookings are also possible at the studio. By proceeding with registration, payment, or booking online through the MindBody Online system, accessible via the website www.swisspilatesandyoga.com, the Client accepts the inherent risk associated with this type of communication.
Studio Swiss Pilates & Yoga's preferred method of communication with the Client is email. Emails exchanged between Studio Swiss Pilates & Yoga and the Client under these terms and conditions are not secure. Therefore, it is possible that these communications may be intercepted by third parties. The Client accepts the inherent risk associated with such communications.
Data protection
During the registration process and as part of the resulting relationship, Studio Swiss Pilates & Yoga collects certain personal information about the Client (including name, address, telephone number, date of birth, gender, occupation, username, password and answer to a security question for online services in the MindBody Online system, email address, information about the Client's health, the Client's credit card number, expiry date and any security codes, and the IP address of the computer used by the Client to connect to the system).
Studio Swiss Pilates & Yoga will under no circumstances disclose the Client's personal data to any third party, unless required to do so by law or a decision of a competent authority.
Studio Swiss Pilates & Yoga may take photos and videos at the studio for marketing purposes and for its website. Studio Swiss Pilates & Yoga has complete freedom in the choice of images, editing, and any necessary cuts, provided that the Client's image rights are respected.
Applicable Law and Jurisdiction in Case of Dispute:
Swiss domestic law applies exclusively. In the event of a dispute, Studio Swiss Pilates & Yoga and the Client submit to the exclusive jurisdiction of the competent ordinary courts of Geneva (GE).
The general terms and conditions are originally published in English. In case of discrepancy between the English and French versions, the English version shall prevail.
